License Agreement

License

All rights granted under this License are granted for the term of copyright on the Program, and are irrevocable provided the stated conditions are met. This License explicitly affirms your unlimited permission to run the unmodified Program. Sublicensing is not allowed.

Warranty

There is no warranty for the program, to the extent permitted by applicable law. Except when otherwise stated in writing the copyright holders and/or other parties provide the program "as is" without warranty of any kind, either expressed or implied, including, but not limited to, the implied warranties of merchantability and fitness for a particular purpose. The entire risk as to the quality and performance of the program is with you. Should the program prove defective, you assume the cost of all necessary servicing, repair or correction, loss of business and income.

The Product is not designed, manufactured or intended for use as on-line control equipment in hazardous environments requiring fail-safe performance, such as in the operation of nuclear facilities, aircraft navigation or communication systems, air traffic control, direct life support machines, or weapons systems, in which the failure of the Product could lead directly to death, personal injury, or severe physical or environmental damage ("High Risk Activities"). Accordingly, Licensor and its suppliers specifically disclaim any express or implied warranty of fitness for High Risk Activities. Licensee agrees that Licensor and its suppliers will not be liable for any claims or damages arising from the use of the Product in such applications.

Author warants that in its original form, this software is not designed to intentionally install maleware, virus, or other harmful software. Author can not garantee that the software has not been illegally modified by third parties, execept that such modifications are violation of this license agreement. Author does not garantee this software does not contain a defect that could be remotely exploited by any malicious individuals or groups, only that the author did not intentionally include malicious functionality intended to cause harm.

Limitation of Liability

In no event unless required by applicable law or agreement to in writing will any copyright holder be liable to you for damages, including any general, special, incidental or consequential damages arising out of the use or inability to use the program (including but not limited to loss of data or data being rendered inaccurate or losses sustained by you or third parties ora failure of the program to operate with any other programs), even if such holder or other party has been advised of the possibility of such damages.

Redistribution

Licensee may redistribute copies of this software in its entirety in its original unaltered form provided redistribution does not violate any exort restrictions. Users of such redistributed software are granted the same license and must agree to the same terms as the Licensee.

Terms

• Licensee may not: decompile, disassemble, reverse engineer, or otherwise attempt to derive the source code for the Product .
• Licensee may not produce any derived works from this application or embed this application within a Licensee developed application.
• Licensee agrees not to distribute modified versions of this software, except for those modifications which are provided by the original author or person or persons granted the right to make modifications by the author.
• Licensee agrees not to reverse engineer the networking protocols used by this software by any means, including disassembling the original code or capturing network traffic for analysis.
• Licensee agrees not to develop software which makes a network connection to this software.
• Licensee agrees not to develop software or take actions intended to interfer with third parties who are using this software, except in cases where all of the following are true:
  • the Licensee has ownership of the equipement or network of the third party.
  • the Licensee has provided the third party with an agreement of use which includes the right to restrict use of software by the third party.
  • the interference of the third party use of the software does not adversly effect the use of anyone other then the third party for which the Licensee has the above established right.
• Licensee agrees not to use this software to download or distribute illegal or copyrighted materials that the Licensee does not have the right to distribute.
• Licensee agrees the author of this software is not responsible for any violation of the above terms and the Licensee assumes full responsibility. Licensee agrees to be soley responsible for the use of this software.
• Licensee agrees that third parties or governmental agencies which have a legal right to any materials that are being illegally distributed can remove those files from the Licensee's computer without futher consent.
• Licensee agrees that these terms remain in effect perpetually, even if this software is uninstalled.
• Licensee agrees to pay the author $100,000 USD for each violation of these terms of agreement. Licensee agrees to pay all other users and third parties $1,000 USD for any violation to these terms that negatively impacts those users or third parties.
• Licensee agrees to make no commercial use of this software, including reselling it, selling support services for it, or selling advertising as a part of redistribution of the software.
• This Agreement constitutes the entire agreement between the parties concerning the subject matter hereof.
• This Agreement may be amended by the Licensor at any time. Licensee agrees to abide by the terms of any revision of the license or discontinue use of the software immediately if the licensee does not agree with the revised terms.
• If any provision in this Agreement should be held illegal or unenforceable by a court having jurisdiction, such provision shall be modified to the extent necessary to render it enforceable without losing its intent, or severed from this Agreement if no such modification is possible, and other provisions of this Agreement shall remain in full force and effect.
• The controlling language of this Agreement is English. If Licensee has received a translation into another language, it has been provided for Licensee's convenience only.

Termination

Without prejudice to any other rights, Licensor may terminate the right to use this software at any time. Upon termination, Licensee shall destroy all copies of the Product. Licensee agrees to continued to be be bound by the terms of this agreement perpetually.
